By registering an account, browsing our marketplace, placing an order, or otherwise using Kibandaski, you confirm that you have read, understood, and agree to these Terms & Conditions and our Privacy Policy. If you do not agree, you must not use our platform.

Kibandaski is an online marketplace that connects vendors and small businesses ("Vendors") with customers across Kenya. Vendors list and sell physical goods through our platform. We provide the technology platform; individual Vendors are solely responsible for the products they list, their quality, and the fulfilment of orders.

• You must be at least 18 years old to create an account.
• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• One person may not maintain more than one active customer account.

You are responsible for all activity that occurs under your account. Notify us immediately at support@kibandaski.shop if you suspect unauthorised access to your account. We reserve the right to suspend or terminate accounts that violate these Terms.

Vendors who register on Kibandaski agree to:

• Provide accurate product descriptions, prices, images, and availability.
• Fulfil accepted orders promptly and in accordance with the listed delivery terms.
• Comply with all applicable Kenyan laws and relevant product safety and consumer protection regulations.
• Maintain an active subscription as required by the platform's subscription model.
• Not list counterfeit, prohibited, stolen, or dangerous goods.

Kibandaski reserves the right to suspend or permanently remove any Vendor who breaches these obligations.

• All prices are listed in Kenyan Shillings (KES) and are inclusive of applicable taxes unless stated otherwise.
• Payments are processed securely via M-Pesa (Lipa Na M-Pesa) or other supported payment methods.
• An order is confirmed only after successful payment authorisation.
• Kibandaski acts as a payment facilitator and is not liable for errors caused by your mobile network or payment provider.

• Customers may request order cancellation before the Vendor has begun processing the order.
• Once processing has started, cancellations are subject to the Vendor's own cancellation policy.
• Refunds for failed or disputed payments are processed within 5–10 business days, depending on your payment provider.
• Kibandaski reserves the right to decline a refund if the claim is found to be fraudulent.

You agree not to:

• Use the platform for any unlawful purpose or in violation of any Kenyan or international law.
• Attempt to gain unauthorised access to any part of the platform or its systems.
• Submit false, misleading, or defamatory reviews or content.
• Use automated scripts, bots, or scrapers to access or collect data from the platform.
• Reproduce, distribute, or resell any part of the platform without our written consent.
• Harass, abuse, or harm other users or Vendors.

All content on Kibandaski — including the logo, design, text, graphics, and software — is owned by or licensed to Kibandaski and is protected by applicable intellectual property laws. You may not copy, modify, or distribute our content without express written permission.

Kibandaski provides its platform on an "as is" and "as available" basis. We do not guarantee that the platform will be uninterrupted, error-free, or free from viruses. We do not warrant the accuracy, completeness, or quality of Vendor listings. Use of the platform is at your own risk.

To the maximum extent permitted by Kenyan law, Kibandaski, its directors, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of data, loss of revenue, or personal injury.

Our platform may contain links to third-party websites (such as payment gateways or logistics providers). These links are provided for convenience only; Kibandaski is not responsible for the content, privacy practices, or availability of any third-party site.

These Terms & Conditions are governed by the laws of the Republic of Kenya. Any disputes arising out of or in connection with these Terms shall first be resolved through good-faith negotiation. Unresolved disputes shall be submitted to the jurisdiction of the courts in Nairobi, Kenya.

We may update these Terms from time to time. We will notify you of significant changes by posting the updated version on this page and, where appropriate, by email. Your continued use of the platform after any changes constitutes your acceptance of the updated Terms.
